Terms of Service

1. Acceptance of Terms

By accessing or using EchoLive ("the Service"), you agree to these Terms of Service. If you do not agree, do not use the Service. We may update these terms at any time; continued use constitutes acceptance of the revised terms.

2. Description of Service

EchoLive is a content and audio platform that allows users to:

  • Subscribe to and read RSS feeds, newsletters, podcasts, and YouTube channels
  • Save and organize articles, bookmarks, and web pages (via web app or browser extension)
  • Search saved content with AI-powered semantic search
  • Generate audio from text using text-to-speech (TTS)
  • Produce and edit audio projects with voice, style, and SSML controls

The Service includes a web application, browser extension, API, and related features.

3. Accounts

  • You must provide accurate information when creating an account.
  • You are responsible for maintaining the security of your account credentials.
  • You must be at least 13 years old (16 in the EU) to use the Service.
  • One person or legal entity per account.

4. Credits & Payments

  • Credits are purchased as one-time packages. No subscriptions are currently offered.
  • Purchased credits expire 365 days after purchase.
  • Free monthly credits reset each calendar month with no rollover.
  • All purchases are final. Refunds are provided only where required by applicable law.
  • Prices may change with reasonable notice.

5. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any laws
  • Generate audio that impersonates real individuals without consent (voice cloning, deepfakes)
  • Upload or generate content that is defamatory, obscene, threatening, harassing, or hateful
  • Upload content that promotes violence, discrimination, or illegal activities
  • Circumvent usage limits, rate limits, or access controls
  • Reverse engineer, decompile, or attempt to extract source code
  • Resell or redistribute generated audio as a competing TTS service
  • Upload content that infringes third-party copyrights, trademarks, or other intellectual property rights
  • Use automated tools (bots, scrapers) to access the Service without authorization
  • Attempt to gain unauthorized access to other users' accounts or data
  • Interfere with or disrupt the Service or servers/networks connected to the Service

Content Moderation: We reserve the right to review, remove, or restrict access to content that violates these terms.

5.5 Browser Extension

  • The EchoLive browser extension is provided as a convenience for saving web content to your account.
  • The extension requires permissions to access page URLs, titles, and selected text. See our Privacy Policy for details on how this data is used.
  • You are responsible for ensuring you have the right to save and store content from third-party websites.
  • The extension may be updated automatically to provide security fixes and new features.

6. Intellectual Property

  • Your content: You retain full ownership of all text, articles, and content you input, save, or organize in EchoLive.
  • Generated audio: Audio files generated via EchoLive are licensed to you for your use. You may use generated audio for:
    • Personal, non-commercial purposes (always permitted)
    • Commercial purposes (e.g., podcasts, videos, courses, audiobooks) as long as you comply with Azure's Neural TTS licensing terms
    • You may NOT resell or redistribute generated audio as a standalone audio product or competing TTS service
    For commercial use, review Azure Speech Service Terms to ensure your use case is compliant.
  • Our platform: EchoLive's software, design, and branding are our intellectual property. You may not copy, modify, or reverse engineer the platform.

7. Privacy

Your use of the Service is also governed by our Privacy Policy. See also our Data Retention Policy and Data Deletion page for details on how we handle your data.

8. Service Availability

  • EchoLive is provided "as is" during the public beta period.
  • We do not guarantee uptime, though we strive for high availability.
  • We may modify, suspend, or discontinue features with reasonable notice.
  • Scheduled maintenance will be communicated in advance when possible.

8.5 Force Majeure

EchoLive is not liable for any failure or delay in performance due to events beyond our reasonable control, including but not limited to: natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, network infrastructure failures, strikes, or shortages of transportation, fuel, energy, labor, or materials.

9. Limitation of Liability

To the maximum extent permitted by law, EchoLive shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, arising from your use of the Service.

9.5 Indemnification

You agree to indemnify and hold harmless EchoLive, its officers, employees, and agents from any claims, damages, or expenses (including legal fees) arising from:

  • Your violation of these terms
  • Your violation of any third-party rights (including intellectual property or privacy rights)
  • Your use of the Service in a manner not permitted by these terms
  • Content you upload, save, or generate through the Service that infringes on third-party rights

10. Termination

  • You may delete your account at any time via the GDPR Rights Center in your account settings.
  • We may suspend or terminate accounts that violate these terms.
  • Upon termination, your data will be deleted per our Data Retention Policy.

11. Governing Law & Disputes

These terms are governed by the laws of the Czech Republic, without regard to conflict of law principles.

Any disputes arising from these terms or your use of the Service will be resolved in the courts of Prague, Czech Republic.

EU Users: Nothing in these terms limits your statutory rights under GDPR, EU consumer protection laws, or your right to bring disputes in your local jurisdiction where permitted by law.

US Users: California residents retain all rights under the CCPA. Nothing in these terms limits your state consumer protection rights.
